Regarding the Request for Determination of Applicability for the reclassification of Amber brook from perennial to intermittent for Northeast Concept, Inc.:  we received from Robert J. McCollum, Wetlands Program Chief, MA DEP dated March 26, 2011, a copy of a letter sent to Chad Brigham, President of Northeast Concept, Inc. stating that “the Assessor’s Map 10, Lot A-6 Mashapaug Rd., Holland, MA is the subject of a Hampden Superior Court ‘Permanent Injunction’, Hampden Superior Court, Civil Action No. 08-1123, filed 11-2-2009 and therefore ‘judicial proceedings affect the ability of the Department or the Applicant to proceed with the application.”

Mary vandenBerg reported having informed David Buccelli of DB Tree, following the site visit on 5-27-11, that he could remove the following trees for Rick and Val Lundin of 21 Shore Dr.: the large pine tree near the driveway and a large oak touching the car port and cut the vine on a nearby oak but not the tree.  Mary vandenBerg signed Procedure Sheet #2011-1459.

Members signed the Certificate of Compliance for Gary Barker, whose project was to repair a lake front wall at 11 Pine Tree Dr., (DEP File #184-0245).

7:30 p.m.  The scheduled Public Hearing of a Notice of Intent for Vincent Donato’s project to repair a septic system at 91 Maybrook Rd. DEP File #184-0257 was held.  No abutters came.  Mark Farrell of Green Hill Engineering reviewed the plot plan.  Following discussion, all were in favor of the project.  Marianne Martone made a motion, and all were in favor, to close the hearing at 8:10 p.m.

Mark Farrell gave us a check paying the Town for 2 Notices of Intent:
1 - Mary vandenBerg of 26 Hamilton Dr. to repair a septic system;
2 - The estate of Janice Swenson of 27 Hamilton Dr. to repair a septic system.

Public Hearings are scheduled for June 28 at 7:30 and 8:00 p.m.

8:20 p.m.  Rick Polverari of 7 Sunset Ln. spoke of his deteriorating lake front wall.  He was informed that a Notice of Intent is required and forms were given.

8:25 p.m.  Jackie and Steven Proko of 22 Collette Dr. drew a sketch of their property and trees that they would like to have removed by Northern Tree.
1 – Healthy oak tree leaning over house;
2 – Dead red maple near house;
3 – Maple between deck and shed and six (6) small white pines, street side, between house and Collette Dr.  All were in favor of the project.  Mary vandenBerg signed Procedure Sheet #2011-EE with the condition that “stumps are not to be removed”.

The meeting was adjourned at 8:45 p.m.
